These terms govern your use of this website and the services provided by Watersmith Tax and Accounting Inc. Please read them carefully.
1Acceptance of these terms
By accessing or using this website and the services of Watersmith Tax and Accounting Inc., you agree to these Terms of Use. If you do not agree, please do not use the website or our services.
These terms govern your use of the website and the information you provide to us through it. They do not replace any engagement letter. Where an engagement letter exists between you and the firm, its terms govern that engagement and prevail over these terms in the event of a conflict.
2Use of our services
You agree to use our website and services solely for lawful purposes. You must not:
- Attempt to gain unauthorised access to any part of the website, the client portal, or any account other than your own
- Interfere with or disrupt the website, or attempt to circumvent its security
- Use automated means to extract content or submit forms
- Submit false, misleading or fraudulent information
- Use the website or services to transmit unlawful, defamatory or harmful material
3Your responsibilities
You are responsible for the accuracy and completeness of the information you provide to us. Our work, including the preparation of returns and financial statements, relies on the records and representations you supply.
We are not liable for errors, penalties, interest or other consequences arising from information that is incorrect, incomplete, or provided late. Where you hold an account on our client portal, you are responsible for keeping your credentials confidential and for activity carried out under your account.
4Nature of the information on this website
The content of this website is provided for general information only. It is not accounting, tax, legal or financial advice, and it does not create a professional relationship between you and the firm.
Tax legislation and accounting standards change, and their application depends on individual circumstances. You should not act on anything found on this website without obtaining professional advice specific to your situation. A professional relationship arises only when we have accepted an engagement in writing.
5Fees and engagement
Every engagement begins with a free initial consultation. Following that consultation we confirm the scope of work and the fee in writing, and work begins only once you have agreed to proceed.
Any pricing shown on this website is indicative and is not an offer. Fees for a specific engagement are those set out in your engagement letter.
6Service availability
We aim to keep this website and our client portal available, but we do not guarantee uninterrupted access. Access may be suspended for maintenance, upgrades, or reasons beyond our control.
Third party services embedded in this website, including scheduling and the client portal, are operated by their providers and subject to their own availability and terms.
7Intellectual property
All content on this website, including text, images, logos, branding, layout and design, is the property of Watersmith Tax and Accounting Inc. or its licensors, and is protected by Canadian and international copyright and trademark law.
You may view, download and print pages for your own personal or internal business use. Any other use, including reproduction, modification, distribution or republication, requires our prior written permission.
8Third party links
This website contains links to websites operated by others, including social media platforms, our scheduling provider and our client portal provider. Those sites are not under our control. We provide the links for convenience and are not responsible for their content, availability or privacy practices.
9Limitation of liability
To the fullest extent permitted by law, Watersmith Tax and Accounting Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or goodwill, arising from your use of, or inability to use, this website or our services.
Our total aggregate liability arising out of or relating to an engagement is limited to the amount of fees paid to us for the services giving rise to the claim.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, and nothing in these terms limits our professional obligations under the rules of the Chartered Professional Accountants of Ontario.
10Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms of Use.
11Changes to these terms
We may modify these Terms of Use at any time. The revised version takes effect when posted on this page, and the date at the top will be updated. Continued use of the website or our services after that point constitutes acceptance of the revised terms.
12Governing law and how to reach us
These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these terms, this website, or our services.
